PAUL HARTMANN AG ("HARTMANN") operates the ACADEMY website at www.hartmann-academy.info. The ACADEMY website is a platform aimed at healthcare professionals, pharmacists, pharmaceutical sales representatives, nurses, nurse practitioners and physicians, as well as resellers. The ACADEMY website offers training, events, webinars and scientific content on incontinence, wound care, disinfection and risk prevention. In this context, the ACADEMY website also offers users additional services through various channels. HARTMANN manages the users' settings as well as the subscription and unsubscription of additional services in connection with the ACADEMY website.

1. Acceptance of the disclaimer and the terms of use, modification of the offer, discontinuation of operation, blocking of access
The user is aware of the content and design of the ACADEMY website.
HARTMANN accepts no responsibility for the topicality, correctness, completeness or quality of the information and services provided. Liability claims against HARTMANN relating to material or immaterial damage caused by the use or non-use of the information and services provided or by the use of incorrect or incomplete information and services are excluded, unless it can be proven that HARTMANN acted with intent or gross negligence.
All offers on the ACADEMY website are subject to change and are non-binding. HARTMANN expressly reserves the right to change, supplement or delete parts or the entire offer without prior notice. HARTMANN is entitled to discontinue the operation of the ACADEMY website in whole or in part at any time. In this respect, HARTMANN assumes no responsibility and is not liable for the uninterrupted availability of the ACADEMY website.
HARTMANN is also entitled to block access to the ACADEMY website at any time without prior notice and without stating reasons.

2. Access to the website, user obligations, use of user data, deletion of the user profile.
For reasons of security and protection of business transactions, only registered users have access to ACADEMY training courses.
All other areas of the Academy website (Hartmann.info) are accessible without user registration.
HARTMANN reserves the right to block access to the ACADEMY website or to parts or areas of the ACADEMY website at its own discretion at any time and without giving reasons, i.e. also for users who are already registered. This applies in particular if a user uses a false identity to mislead others; violates these Terms of Use or neglects his or her duty of care with regard to user data.
The availability of the chargeable contents shall be technically implemented by HARTMANN in such a way that HARTMANN makes these contents available to the users in principle, or at least within the scope of the technical standard customary in the market. HARTMANN will take suitable and reasonable measures to guarantee users constant access to the website and constant availability of the chargeable content. However, availability at all times is expressly not guaranteed. In particular, access may be temporarily restricted for technical reasons, e.g. due to necessary maintenance and repair work.

3. Costs
The use of the Academy website is both paid and free of charge.
All training courses are associated with costs. However, HARTMANN's national companies may offer discounts or free training as part of a loyalty program.

4. Rights of use of information, software and documentation
HARTMANN's use of the information, training, software and documentation made available on the ACADEMY website as well as any updates thereof ("ACADEMY contents") shall be subject to these terms and conditions, whereby separately agreed license conditions shall always take precedence over these terms and conditions.
HARTMANN grants the user a non-exclusive, non-transferable and non-assignable right to use the contents of the ACADEMY website and training materials to the extent agreed between HARTMANN and the user or, in the absence of such an agreement, to the extent that corresponds to the purpose obviously pursued by HARTMANN in making the ACADEMY contents and training materials available.
The user shall not pass on the ACADEMY contents and training materials to third parties or make them accessible in any other way. Unless mandatory legal provisions to the contrary apply, the user may not modify, disassemble, decrypt or decompile ACADEMY content.
The ACADEMY Content and Training Materials are protected by copyright laws, international copyright treaties and other intellectual property laws and agreements, and the User shall comply with such laws and agreements. In particular, the User shall not remove any alphanumeric codes, trademarks or copyright notices from the ACADEMY Content and Training Materials.

5. Responsibility for posted content, right of deletion, copyright and trademark law
All content that the user posts on the ACADEMY website (e.g. contributions, comments, etc.) is the sole responsibility of the individual user. HARTMANN cannot be held liable in the event of a violation of applicable law. However, HARTMANN reserves the right to delete such content that violates applicable law (in particular in the case of violation of personal rights of other users) at any time without prior notice.
All trademarks and other proprietary rights mentioned within the ACADEMY content and possibly protected by third parties are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners. The mere mention of a trademark does not imply that it is not protected by the rights of third parties. The copyright for published objects created by HARTMANN itself remains solely with HARTMANN. Reproduction or use of copyrighted content is not permitted without the prior written consent of HARTMANN.

6. Further user obligations
When visiting the ACADEMY website, the user must not:
-infringe the personal rights of third parties
-infringe intellectual property or other proprietary rights;
-upload, store or distribute content containing malware such as viruses, Trojans, worms, spyware or other malicious programmes;

-distribute advertising material or unsolicited e-mail ("spam"), including false warnings of viruses, defects, etc.
If the user violates any obligation arising from the aforementioned terms of use, HARTMANN will immediately block access to the ACADEMY website, without prejudice to other legal remedies.

7. Exclusion of liability
HARTMANN is not responsible for any contents linked or referred to from his pages - unless he has full knowledge of illegal contents and would be able to prevent the visitors of his site from viewing those pages. 8. Defects of quality and title
Any express or implied warranty or liability for defects in quality or title of the ACADEMY Content is excluded, including warranties of accuracy, completeness, merchantability and/or fitness for a particular purpose or non-infringement, except in cases of willful misconduct, gross negligence, personal injury or death.
The contents of the ACADEMY may contain general descriptions of the technical possibilities of individual HARTMANN products, which may not always be available in individual cases (e.g. due to product changes). These general descriptions do not claim to be complete or correct. Such general descriptions are also not to be understood as contractual guarantees and the user accepts that the required performance of the products corresponds to the performance agreed at the time the contract was concluded.

9. Jurisdiction
The place of jurisdiction for all disputes arising in connection with the use of the ACADEMY website shall be the Stuttgart Regional Court, provided that the parties to the respective contractual relationship are merchants within the meaning of the German Commercial Code (HGB).
10. Severability clause, amendment of these terms and conditions, applicable law, applicability of terms of delivery and payment.
HARTMANN reserves the right to change these terms of use at any time and without giving reasons.

These terms and conditions shall be governed exclusively by German law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11.4.1980 (UN Sales Convention).
In all other respects, HARTMANN's terms and conditions of delivery and payment shall apply. These are either available at any time at https://hartmanndirect.com/de-de/agb or can be viewed directly at HARTMANN.
Should any provision of these terms and conditions be or become invalid in whole or in part, or should there be a gap in these terms and conditions, this shall not affect the validity of the remaining provisions of these terms and conditions. In place of the invalid provision and to fill any gaps, the statutory provision shall apply. If the invalidity of a condition is based on a measure of performance or time (deadline or date) specified in the condition, it shall be replaced by the legally permissible measure that comes closest to the condition.
